(b) All provisions of the civil court shall apply to the residential portion whenever possible, unless the law provides otherwise or otherwise provided for in this section. (2) Form of subpoena. The subpoena in a case involving an action in the residential part for the recovery of civil penalties is made in the form that may be announced by the lead administrator. In civil law systems where there are codes, the main source of law is the Code of Law, a systematic set of interconnected articles[8] arranged by subject in a predetermined order. [9] The codes explain the principles of law, rights and rights and the functioning of basic legal mechanisms. The purpose of codification is to provide all citizens with manners and a written compendium of the laws that apply to them and to which judges must obey. Codes of law are laws passed by a legislature, although they are usually much longer than other laws. Instead of a compendium of laws or a catalogue of jurisprudence, the Code establishes general principles as legal norms. [8] Other important legal systems in the world are customary law, Islamic law, halakha and canon law. (l) No disclosure or compilation of information is permitted without a court order in an action or proceeding to impose a civil penalty in the residential portion.
Louisiana`s private law is first and foremost a Napoleonic system. Louisiana is the only U.S. state based in part on French and Spanish codes and, ultimately, on Roman law, as opposed to English customary law. [22] In Louisiana, private law has been codified in the Louisiana Civil Code. Current Louisiana law has moved considerably closer to U.S. law, including public law, the judicial system, and the adoption of the Uniform Commercial Code (with the exception of Section 2) and certain legal provisions of U.S. common law. [23] In fact, any innovation, whether private or public, is decidedly common law in its original nature.
[Citation needed] Quebec law, whose private law is also of civil French origin, has evolved in the same direction, adapting in the same way as Louisiana to public law and the judicial system of Canadian common law. In contrast, private law in Quebec has developed primarily from civil sources. To a lesser extent, other states that were part of the Spanish Empire, such as Texas and California, also incorporated aspects of Spanish civil law into their legal systems, such as community property. Puerto Rico`s legal system is similar to Louisiana`s: a civil code whose interpretations are based on both the civil and common law systems. Since the Civil Code of Puerto Rico is based on the Spanish Civil Code of 1889, the available jurisdiction has tended to be based on innovations in the common law due to the age of the Code and, in many cases, due to its outdated nature. Civil law systems, also called continental or Romano-Germanic legal systems, can be found on all continents and cover about 60% of the world. They are based on concepts, categories and rules derived from Roman law, with some influence from canon law, sometimes largely supplemented or modified by local customs or cultures. The tradition of civil law, although secularized over the centuries and more focused on individual freedom, promotes cooperation between peoples.
Some authors consider civil law as the basis of the socialist law used in communist countries, which from this point of view would essentially be civil law with the addition of Marxist-Leninist ideals. Even if this was the case, civil law was generally the legal system that existed before the rise of socialist law, and some Eastern European countries reverted to pre-socialist civil law after the fall of socialism, while others continued to use a socialist legal system. Historically, civil law is the group of legal ideas and systems that are ultimately derived from the Corpus Juris Civilis, but are strongly superimposed by Napoleonic, Germanic, canonical, feudal, and local practices,[2] as well as doctrinal tribes such as natural law, codification, and legal positivism. Several Islamic countries have civil law systems that contain elements of Islamic law. [24] For example, the Egyptian Civil Code of 1810, which developed in the early 19th century – which is still in force in Egypt, the basis of civil law in many countries in the Arab world where civil law is used – is based on the Napoleonic Codex, but its lead author Abd El-Razzak El-Sanhuri tried to integrate the principles and characteristics of Islamic law, to take into account the unique circumstances of Egyptian society. (b) Electronic filing in civil court actions. (1) Except as otherwise provided in this Section, section 22 of the NYCRR, section 202.5-b and, where applicable, section 202.5-bb apply to all actions for which electronic filing is permitted in civil court. References in sections 202.5-b and 202.5-bb to the Chief Clerk of the Supreme Court or the Clerk of any court shall be deemed to be the Chief Registrar of the Civil Court, if any, and references in this Section to the CPLR may include the Civil Courts Act of the City of New York and the Real Estate Actions and Procedures Act. (2) Launching an action electronically.
(i) Except as otherwise provided in Subsection (a) of this Section, a party may bring any action in the civil court of any district (provided that electronic filing has been approved in that district and in the type of action to which such action belongs pursuant to Subsection (a) of this Section) by submitting the introductory documents electronically to the Clerk of the Court via the NYSCEF website. (ii) Documents filed electronically to bring an action under this Section are deemed to have been filed with the Clerk of the County Civil Court where the action under Section 400 of the Civil Court of the City of New York Is filed on the date of receipt of such documents on the NYSCEF website. as well as the payment of the required fees. (iii) No later than the close of business on the business day following the day the initiating documents are filed electronically to bring a legal action pursuant to paragraph (ii) of this paragraph, a notice of confirmation from the NYSCEF website will be sent electronically to the person submitting such documents.
