A wonderful book. I do not know of any such thing. Once upon a time there was a wonderful corpus of law known as ius commune (loosely translated as “customary law”). But that customary law was. ЧР̧ÑаÑÑ Ð²ÐμÑÑ Ð3/4Ñз Ñв From the modern era, the author looks back at a time when Europe had a common law that transcended national and legal boundaries. This customary law, called Bellomo ius commune, developed in the twelfth century from the fusion of Roman, canonical and feudal law. Within the framework of the ius commune existed the local laws or iura propria – the innumerable laws of daily life, the laws specific to the different kingdoms, principalities, cities, guilds and secular and ecclesiastical bodies. Bellomo shows how, for centuries, the common ius has permeated all aspects of the iura propria and has indelibly shaped European law with its cachet. Since the iura propria emerged from the unifying norms and principles of the ius commune, one cannot properly understand the local European legal systems without first understanding the ius commune and its influence on the legal concepts, institutions, procedures, documents and teachings of the iura propria. With a power and passion rarely found in a scholarly text, Manlio Bellomo wrote a vast history of the legal tradition of Western Europe.
It is now made available to an English-speaking audience in an elegant and clear translation of the Italian original. Bellomo combines its long history with the concerns of modern times, arguing first that the codification that took place in European countries during the eighteenth and nineteenth centuries brought ambiguity, rigidity and uncertainty to legal systems. A new common law for all of Europe, he argues, would provide a much better means of legal change and development at a time when economic barriers between European nations are collapsing. After preparing the ground for a historical treatment of the subject, Bellomo describes the beginnings of the common ius in the schools of the twelfth century, discusses the development of the Italian, French and German iura propria, and describes the great jurists who gave the common law its intellectual power – Gratian, Accursius, Odofredus, Cinus and Bartolus. It ends with an account of the humanist jurists of the fifteenth, sixteenth and early seventeenth centuries. Lecturers will find this text ideal for use in courses in legal history, political history and the history of canon law. Manlio Bellomo studied with Francesco Calasso at the University of Rome and now teaches the history of law at the University of Catania. He is co-director of the International School of Ius Commune in Erice, Sicily, and editor-in-chief of the journal Rivista internazionale di diritto comune.
